Car insurance dilemma, help!!!!?

I recently was in an wreck where I struck the back end of a moving vehicle while I was pulling out of a parrellel parkin. I was uninsured and unliscenced. I am in the process of getting my liscence. However, my car is under both mine and my fiance's name. He purchased the insurance under his name. Should I have gotten the insurance under my name? My court date is tomorrow. What should I tell the judge if he see's the insurance under my fiance's name and doesn't aprrove?
